TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern your access to and use of all courses, training programs, coaching services, memberships, websites, communities, content, and related services provided by Elite Singer LLC ("Company," "we," "us," or "our").

By purchasing, accessing, or participating in any Service offered by Elite Singer LLC, you agree to be bound by these Terms.

 

1. Acceptance of Terms

By accessing or using any portion of the Services, you acknowledge that you have read, understood, and agree to comply with these Terms & Conditions.

If you do not agree to these Terms, you may not access or use the Services.

 

2. Eligibility

You must be at least eighteen (18) years old or have the consent of a parent or legal guardian to participate in the Services.

 

3. Intellectual Property

All content provided by Elite Singer LLC, including but not limited to:

  • Training programs

  • Course materials

  • Videos and recordings

  • Written lessons and scripts

  • Vocal exercises and methodologies

  • Logos

  • Trademarks

  • Branding materials

  • Graphics and images

  • Website content

  • Downloadable resources

is the exclusive property of Elite Singer LLC and is protected by copyright, trademark, and intellectual property laws.

Your purchase grants you a limited, revocable, non-transferable, non-exclusive license to access and use the content solely for your personal educational purposes.

You may not:

  • Reproduce or copy materials

  • Share course content

  • Record or redistribute lessons

  • Sell or sublicense materials

  • Create derivative works

  • Use Company materials for commercial purposes

without prior written permission from Elite Singer LLC.

 

4. Account Security and Prohibited Sharing

Users are responsible for maintaining the confidentiality of their account credentials.

Accounts, memberships, and course access may not be shared, sold, transferred, sublicensed, or otherwise provided to any third party.

Elite Singer LLC reserves the right to suspend or terminate any account suspected of unauthorized sharing or misuse.

No refunds will be provided for accounts terminated under this provision.

 

5. User-Generated Content

Users may upload content including but not limited to:

  • Videos

  • Audio recordings

  • Images

  • Comments

  • Messages

  • Other submissions

You retain ownership of your original content.

By uploading content, you grant Elite Singer LLC a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and use such content solely for the operation, administration, improvement, and promotion of the Services.

You represent and warrant that:

  • You own or control the rights to the content.

  • The content does not infringe on any third-party rights.

  • The content does not violate any law.

  • The content complies with these Terms.

Elite Singer LLC may remove any content at its sole discretion.

 

6. Community Standards and Conduct

The community is intended to be a respectful, supportive, and professional environment.

The following conduct is prohibited:

  • Hate speech

  • Harassment or bullying

  • Discrimination based on race, ethnicity, religion, national origin, sex, gender identity, sexual orientation, disability, or protected status

  • Threatening behavior

  • Abusive or offensive language

  • Obscene content

  • Spam or solicitation

  • Unlawful conduct

  • Personal attacks against members

If a participant violates these standards:

  1. A warning may be issued.

  2. Continued violations may result in suspension.

  3. Repeated or serious violations may result in permanent removal.

Elite Singer LLC reserves the right to immediately remove any user for severe misconduct at its sole discretion.

No refunds will be provided to users removed for violating community standards.

 

7. Vocal Training Disclaimer

Participation in any vocal training, singing exercises, demonstrations, coaching sessions, workshops, community activities, or educational materials is entirely voluntary and undertaken at your own risk.

You acknowledge and agree that:

  • Vocal training may involve physical exertion and vocal strain.

  • Results vary between individuals.

  • Improper use of techniques may cause discomfort or adverse effects.

You are solely responsible for monitoring your own physical condition and vocal health.

Elite Singer LLC shall not be responsible or liable for any injury, discomfort, pain, vocal damage, medical expenses, loss of income, loss of performance opportunities, or other damages arising from participation in the Services.

Participation is entirely at your own discretion and risk.

 

8. No Medical Advice

All information provided through the Services is for educational purposes only.

Nothing contained within the Services constitutes medical, healthcare, therapeutic, diagnostic, or professional medical advice.

Users should consult qualified healthcare professionals regarding any concerns related to vocal health or physical well-being.

 

9. Payments and No-Refund Policy

All purchases are final.

Elite Singer LLC maintains a strict no-refund policy.

No refunds, credits, chargebacks, or partial refunds will be issued for any reason, including but not limited to:

  • Failure to complete the program

  • Lack of participation

  • Scheduling conflicts

  • Dissatisfaction with results

  • Failure to attend live sessions

  • Technical issues outside the Company's control

  • Account termination due to Terms violations

  • Change of personal circumstances

By purchasing any Service, you expressly agree to this no-refund policy.

 

10. Subscription Billing and Automatic Renewal

Certain Services may be offered through recurring subscriptions.

By purchasing a subscription, you authorize Elite Singer LLC to automatically charge your payment method on a recurring basis until canceled.

Subscriptions automatically renew on the same calendar day of each billing cycle corresponding to the original purchase date.

For example, if a subscription begins on the 15th day of a month, future billing cycles will generally occur on the 15th day of each month thereafter.

Subscribers are responsible for maintaining valid payment information.

If payment fails, Elite Singer LLC may suspend or terminate access until payment is successfully processed.

Cancellation requests stop future renewals only and do not entitle the subscriber to any refund.

 

11. Recording Consent

Elite Singer LLC may record:

  • Group coaching sessions

  • Workshops

  • Webinars

  • Training calls

  • Community events

  • Educational presentations

By participating, you consent to the recording of your:

  • Voice

  • Image

  • Likeness

  • Comments

  • Participation

You grant Elite Singer LLC permission to use, reproduce, distribute, display, publish, and otherwise utilize such recordings for educational, operational, promotional, marketing, and business purposes without additional compensation. If a recording is being used for promotional or marketing materials, your permission will be requested if you’re featured in it.

If you do not wish to appear in recordings, you are responsible for disabling your camera, refraining from participation, or notifying the Company when possible.

 

12. Privacy and Data Collection

Elite Singer LLC may collect information including:

  • Name

  • Email address

  • Contact information

  • Account information

  • Uploaded videos

  • Uploaded audio recordings

  • Uploaded images

  • Community activity

  • Usage analytics

Information may be used to:

  • Provide Services

  • Process payments

  • Improve user experience

  • Deliver customer support

  • Monitor platform security

  • Communicate with users

  • Conduct marketing activities where permitted by law

Elite Singer LLC does not sell personal information to third parties.

Information may be shared with payment processors, hosting providers, technology vendors, and service providers necessary to operate the Services.

While reasonable safeguards are employed, no internet-based system can guarantee absolute security.

 

13. Copyright and DMCA Policy

Elite Singer LLC respects intellectual property rights and expects users to do the same.

Users may not upload or share content that infringes the rights of others.

If the Company receives a good-faith claim of infringement, Elite Singer LLC may remove or disable access to the content while the matter is reviewed.

Repeat infringers may have their accounts permanently terminated.

Copyright infringement notices should include:

  • Identification of the copyrighted work

  • Identification of the allegedly infringing material

  • Contact information

  • A statement of good-faith belief that the use is unauthorized

  • A statement under penalty of perjury that the information is accurate

  • A physical or electronic signature

14. Termination of Access

Elite Singer LLC reserves the right to suspend, restrict, or terminate access to any user at any time for:

  • Violation of these Terms

  • Community misconduct

  • Copyright infringement

  • Account sharing

  • Abuse of the platform

  • Any activity deemed harmful to the Company or its members

Termination shall not create any obligation to provide a refund.

 

15. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

Elite Singer LLC makes no warranties, express or implied, regarding:

  • Availability

  • Reliability

  • Accuracy

  • Fitness for a particular purpose

  • Specific outcomes or results

All use of the Services is at your own risk.

 

16. Limitation of Liability

To the fullest extent permitted by law, Elite Singer LLC, its owners, employees, contractors, affiliates, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of the Services.

The maximum liability of Elite Singer LLC for any claim shall not exceed the amount paid by the user to Elite Singer LLC during the twelve (12) months preceding the event giving rise to the claim.

 

17. Indemnification

You agree to defend, indemnify, and hold harmless Elite Singer LLC and its owners, officers, employees, contractors, affiliates, agents, and representatives from any claims, liabilities, damages, losses, costs, or expenses arising out of:

  • Your use of the Services

  • Your uploaded content

  • Your violation of these Terms

  • Your violation of any law or third-party rights

 

18. Modifications to Terms

Elite Singer LLC reserves the right to modify these Terms at any time.

Updated Terms become effective upon posting.

Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

 

19. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to conflict of law principles.
